OptimHal-ProtecSom designs, manufactures, and markets medical devices for protecting patients with dust mite allergies, and medical devices for the pulmonary deposition of medications, notably online via https://boutique-allergie-fr.protecsom.com (hereinafter referred to as the "Shop").

The Shop is owned and operated by OptimHal-ProtecSom SAS. The publication director is Alexis PORÉE. The website is hosted by OVH, located at 2 rue Kellerman, 59100 Roubaix, France.

2. GENERAL PRINCIPLES

These General Terms and Conditions of Sale define the terms of online sales concluded between OptimHal-ProtecSom SAS and any consumer making a purchase through the Online Store.
They are written in French in their original version, which alone is authentic and prevails over any other version.
These General Terms and Conditions of Sale apply to the exclusion of all other terms and conditions. They are accessible to the Customer on the Online Store at any time and are systematically presented to the Customer before any order and at the time of order registration.

When opening a Customer Account, clicking on the "I accept the general terms and conditions of sale" button signifies the Customer's consent to the application of these general terms and conditions of sale.

The Customer declares having read the following provisions before ordering the Products. Consequently, placing an order implies the Customer's full and unreserved acceptance of these General Terms and Conditions of Sale.

A printed version of these General Terms and Conditions of Sale, as well as any information sent electronically, shall be admissible in any legal proceedings concerning the application of these General Terms and Conditions of Sale in the same manner and under the same conditions as any other written document kept in paper format.

The failure to exercise, at any time, any right granted by these General Terms and Conditions of Sale, or to demand the application of any provision of the agreement arising from said Terms and Conditions, shall not be construed in any way as a modification of the contract, nor as an express or implied waiver of the right to exercise said right in the future, or of the right to demand strict performance of the commitments undertaken herein.

Should any provision of these General Terms and Conditions of Sale be deemed illegal or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.

Modification of the Online Terms and Conditions of Sale
Given the potential for changes to the Website, OptimHal-ProtecSom SAS reserves the right to adapt or modify these Terms and Conditions of Sale at any time. Therefore, OptimHal-ProtecSom encourages Customers to review the Terms and Conditions of Sale before placing any new order. The Terms and Conditions of Sale in effect at the time of publication will apply to all orders placed from the date they are published online.

3. LEGAL MAJORITY AND CAPACITY

The Client declares that he is legally capable of entering into this Contract, the General Terms and Conditions of Sale of which are presented below, i.e. that he is of legal age and not under guardianship or curatorship.

4. PRODUCTS

The essential characteristics of the Products are described for each Product in the online catalogue.

5. CUSTOMER ACCOUNT

To place an order online in the Shop, you must create a Customer Account. To create your account, you will be asked to provide your first name, last name, and email address. Once your Customer Account has been created, a confirmation email will be sent to the email address you provided. You agree to provide OptimHal-ProtecSom SAS with accurate, up-to-date, and complete information and to maintain its accuracy. You agree not to create an account under a false identity. It is your responsibility to keep your personal information up to date. Your login ID is your email address. Access to your Customer Account is protected by a personal and confidential password. You agree to keep your password secret and not to share it with any third party for any reason whatsoever. You are responsible for your password. If the Client notices that their account is being used fraudulently, they agree to report it immediately to OptimHal-ProtecSom SAS.

6. ORDER

The Customer places their order from the online catalogue of OptimHal-ProtecSom SAS.

All orders can be placed via the Shop, by phone or by mail.

It is specified that an order is only validated after receipt of payment.

All orders imply acceptance of the product descriptions and prices in effect on the day of the order.

To place an order online in the Shop, the Customer must:

– Fill your basket with one or more Products;

– Log in with your email and password if you already have a Customer Account, or create a Customer Account.

– Enter the billing and/or delivery address;

– Choose the delivery method.

Once the order is complete, the Customer can review the ordered Products, the total price, and the order details. They then choose their payment method. If necessary, they can modify or review the order before final confirmation.

The order will only be definitively registered upon receipt of full payment. This action is equivalent to a handwritten signature as defined in Article 1367 of the French Civil Code and to the conclusion of a contract in electronic form as defined in Articles 1127-1 and 1127-2 of the French Civil Code. From the date of this action:

– The Customer confirms their order and declares that they accept it, as well as these General Terms and Conditions of Sale in their entirety, fully and without reservation; and

– The order is considered irrevocable and can only be challenged in the limited cases provided for herein.

The invoice and order details are accessible from the customer account.

7. ORDER CONFIRMATION

Upon registration of the order by the Customer, an order confirmation is sent to the email address previously provided by the Customer. This confirmation specifies the exact amount charged, the products ordered and their quantity, and the delivery details. This confirmation constitutes acceptance of the order by OptimHal-ProtecSom SAS and validates the transaction.

The Customer accepts that the order registration systems constitute proof of purchase and its date. By saving and/or printing this email, the Customer retains proof of their order, which OptimHal-ProtecSom SAS recommends they keep.

This email confirms that the Customer's order has been received by OptimHal-ProtecSom SAS and not that the ordered Product is available.

OptimHal-ProtecSom SAS undertakes to fulfill online orders only within the limits of available stock.

If a product is unavailable, OptimHal-ProtecSom SAS will inform the Customer as soon as possible by email or telephone. If the ordered product is unavailable, the Customer may either cancel or modify their order. In the event of cancellation due to unavailability, the Customer will be refunded within fourteen (14) days of receipt of their cancellation request.

8. PRICE

Product Prices

Orders placed on this online store are binding and require payment. Product prices are shown in euros, inclusive of all taxes, for mainland France and Europe. Prices include VAT at the rate applicable on the date of the order. If the delivery area specified by the customer is in an overseas territory or outside Europe, product prices will be shown in euros, excluding tax.

The prices quoted do not include shipping costs, which are the responsibility of the Customer, in accordance with the provisions of article 9 below.

Promotional offers are valid only within the dual limits of the validity period of the offer in question and available stock.

Cost of using a remote communication technology. Access to the Site is via the Internet. The Client is responsible for the costs of accessing the Internet network using a remote communication service.

9. SHIPPING COSTS

The shipping costs include insurance which guarantees the customer the effective delivery of their order, its replacement in case of transport damage or its refund including shipping costs.

This flat-rate contribution is the sole responsibility of the customer, and is automatically updated according to the delivery location and mode of transport indicated when validating their order.

Indicative prices updated as of January 2, 2025, subject to change without notice. The shipping costs indicated at the time of order confirmation by the customer shall prevail

Return shipping costs are the sole responsibility of the customer.

10. PAYMENT 

Payment for the order is due in full on the day the order is placed. Payment, as defined in this article, is constituted by the actual release of funds to OptimHal-ProtecSom SAS.

Payment methods:

Invoices are payable in euros at the headquarters of OptimHal-ProtecSom SAS.

Payment for the order is made online:

– By credit card via the secure payment interface.

– Via the secure PayPal payment interface

– By bank check made payable to and sent to the address of OptimHal-ProtecSom SAS, dated the day of your order. For faster processing of your order, simply write your order number on the back of your check (the check will be deposited upon receipt).

– By bank transfer. For prompt processing of their order, the Customer must include their order number in the transfer reference. Any bank transfer fees charged by the Customer's bank will be their responsibility.

In all these cases, the order will be processed upon receipt of payment and subject to its clearance. OptimHal-ProtecSom SAS retains ownership of the items sold until full payment of the agreed price, including shipping costs.

To optimize the security of online transactions, the Store uses an SSL (Secure Socket Layer) online payment system so that all means are implemented to ensure the confidentiality and security of the data transmitted, within the framework of an online payment.

Our online payment system Monetico (Crédit Mutuel/CIC) automatically checks the validity of access rights when paying by bank card and encrypts all exchanges to guarantee confidentiality.

To benefit from the secure SSL payment method, the Customer must use browsers compatible with the SSL system.

11. DELIVERY

Delivery methods

Delivery is available in mainland France and the European Union.

The package number will be provided to the Customer by email, allowing them to track their delivery (in case of non-receipt, the Customer should check their spam folder).

Shipping costs will be charged at the rate in effect on the day of the order.

The Customer is informed of the delivery terms before final validation of their order.

delivery time

Delivery times are indicated on the online store during order confirmation. They vary depending on the destination and the chosen delivery method. Delivery times begin upon receipt of payment by OptimHal-ProtecSom SAS.

If several items ordered at the same time have different delivery dates, the latest delivery date will be applied. However, in this case, OptimHal-ProtecSom SAS reserves the right to deliver the order in multiple shipments.

Delivery times are provided for informational purposes only. We make every effort to meet them as closely as possible. However, any delay will not give rise to penalties, order cancellation, refusal of goods, or claims for damages.

Failure to meet delivery deadlines shall not give rise to the payment of any compensation.

12. RECEIPT OF PRODUCTS

The Customer is required to check the condition of the packaging and the conformity of the Product upon delivery. The Customer must immediately inform the delivery driver of any reservations they wish to make regarding the condition of the delivered Product so that these are noted on the transport document: damaged packaging, damage incurred, conformity with the order, etc.

Any claim regarding apparent defects or non-conformity of the delivered Product with respect to the information given during the presentation of the Product on the Site, as well as any damage related to transport, must be confirmed by the Customer to OptimHal-ProtecSom SAS within 48 hours of receiving the Product, either by registered letter with acknowledgment of receipt to the following address: OptimHal-ProtecSom SAS – BP 46 – 50700 VALOGNES – France, or by email to the address via our contact form ( https://boutique-allergie-fr.protecsom.com/contactez-nous ).

The Client must provide all justifications regarding the reality of the non-conformities, damage or defects observed.

In the absence of a claim made within the aforementioned time and conditions, the delivered Products will be deemed accepted by the Customer.

By reporting the defect or non-conformity of the Product, the Customer will obtain a return authorization from OptimHal-ProtecSom, specifying the address and terms of return of the Products.

Once the return authorization has been obtained, the Customer reships the Products to OptimHal-ProtecSom SAS at the address specified on the return authorization according to the terms indicated.

Any Product reshipped without the agreement of OptimHal-ProtecSom SAS will be refused and returned to the sender at the latter's expense and risk.

To be validly returned to OptimHal-ProtecSom SAS and/or exchanged, the Products must not have been used and must be returned intact in their original packaging with any accessories, user manuals and other documentation.

If the Customer returns a Product due to a proven and confirmed defect, as determined by OptimHal-ProtecSom SAS, the Customer must use the same delivery method for the return shipment as the one chosen for the original shipment. In this case, OptimHal-ProtecSom SAS will cover the return shipping costs by issuing a prepaid return label or, failing that, by reimbursing the Customer for the actual amount of said costs (proof of postage must be included in the package; if this is not included, the Customer will not be entitled to a refund).

13. SPONSORSHIP

The conclusion of a sponsorship operation implies the sponsor's unreserved and unrestricted acceptance of these General Terms and Conditions of Sale, as well as compliance with the regulations in force concerning sponsorship.

13.1. Implementation

A referral system has been set up for all customers who have already placed an order on our online store ( https://boutique-allergie-fr.protecsom.com ).

13.2. Conditions of participation

Referrers and referred customers agree, in particular, not to use the ProtecSom referral program fraudulently, abusively, improperly, or maliciously. Any fraudulent, abusive, improper, or malicious use of the referral program will result in the deletion of the customer accounts involved and the cancellation of any benefits obtained through the referral program.

Conditions of access to the program for the Sponsor

This offer is open to all people who have already validated and paid for an order on our shop ( https://boutique-allergie-fr.protecsom.com ).

The referral will be valid once the referred customer's order has been validated and paid for. The Customer may refer the person of their choice, provided that person has never placed an order with OptimHal-ProtecSom SAS and therefore does not have a customer account on the online store. Similarly, only adults or emancipated minors may participate in this referral program. Please note that the referral cannot be retroactive under any circumstances. A referrer cannot claim a referral retroactively. Likewise, a referrer may not refer a member of the same household or refer themselves. It is also not permitted to share referral information on a website, social network, or any other public communication channel for the purpose of obtaining referral rewards.

Conditions of access to the program for the sponsored child

A new customer can only have one sponsor. The new customer must never have been a customer of OptimHal-ProtecSom SAS.

13.3. Sponsor's Compensation

Once the referral's order has been validated and paid for, the referrer will receive a €10 discount voucher in their customer account for our store https://boutique-allergie-fr.protecsom.com .

If the referred customer's order is cancelled within 30 days of its delivery date, the rewards associated with this referral will be cancelled.

The godfather can only receive one gift per godchild.

The sponsor can sponsor up to a maximum of 5 godchildren.

13.4. Rewarding the Godson

Once his sponsor is registered, the sponsored person benefits from a 5% discount voucher on his first order at ProtecSom.

14. WARRANTY

Warranty of conformity and legal warranty against hidden defects

The Customer benefits from the legal guarantee of conformity (articles L. 217-4 to L. 217-12 of the Consumer Code) and the legal guarantee relating to defects in the thing sold (articles 1641 to 1648 and 2232 of the Civil Code).

GUARANTEE OF CONFORMITY

Article L. 217-4 of the Consumer Code:

The seller delivers goods that conform to the contract and is liable for any defects in conformity existing at the time of delivery.

He is also liable for defects in conformity resulting from packaging, assembly instructions or installation when the latter was his responsibility under the contract or was carried out under his supervision.

Article L. 217-5 of the Consumer Code:

If it is fit for the purpose for which similar goods are normally used and, where applicable:

– if it corresponds to the description given by the seller and possesses the qualities that the latter presented to the buyer in the form of a sample or model;

– if it possesses the qualities that a buyer can legitimately expect, having regard to the public statements made by the seller, the producer or their representative, particularly in advertising or labelling;

Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special purpose sought by the buyer, brought to the seller's attention and accepted by the latter.

Article L. 217-12 of the Consumer Code:

The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods.

Article L. 217-16 of the Consumer Code:

When the buyer requests the seller, during the course of the commercial warranty granted to him during the acquisition or repair of a movable good, to carry out a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining duration of the warranty.

This period begins from the date of the buyer's request for intervention or the date the goods in question are made available for repair, if this latter date is later than the request for intervention.

GUARANTEE AGAINST HIDDEN DEFECTS

Article 1641 of the Civil Code:

The seller is bound by the warranty against hidden defects in the thing sold which render it unfit for the use for which it is intended, or which diminish this use to such an extent that the buyer would not have acquired it, or would have given only a lower price, if he had known of them.

Article 1648, paragraph one of the Civil Code:

The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.

15. Reparations Fund and Extended Producer Responsibility (EPR)

The textile products we sell, such as household linen, fall under the Extended Producer Responsibility (EPR) Textiles scheme.

However, these types of products are not eligible for the Repair Bonus provided by the Repair Fund. This scheme applies only to specific product categories.

OptimHal-ProtecSom SAS contributes financially to the EPR sector to support the collection, sorting and recycling of used textiles.

16. RESPONSIBILITY

Information

OptimHal-ProtecSom SAS strives to ensure, to the best of its ability, the accuracy and timeliness of the information published on the Online Store, which it reserves the right to modify at any time and without prior notice. Similarly, the photographs and texts used to illustrate the Products are not contractual. Consequently, OptimHal-ProtecSom SAS cannot be held liable for any errors in these photographs or texts.

Product compliance with applicable standards

OptimHal-ProtecSom SAS undertakes to sell Products that comply with the regulations and standards in force in the European Union at the time of sale.

Use of the Site

The use of and browsing of the Site are the responsibility of the Client. OptimHal-ProtecSom SAS disclaims all liability and shall not be held responsible for any damage or viruses that may affect computer equipment or any other material during access to, use of, or browsing of the Store, or the downloading of any content, data, text, images, or files from the Store.

Improper use/installation of the product

OptimHal-ProtecSom SAS declines all responsibility and cannot be held liable for any damage caused to the Client or to a third party due to use of the Product not in accordance with its intended purpose.

17. RIGHT OF WITHDRAWAL

In accordance with Article L. 221-18 of the Consumer Code, the Customer who concludes a contract through a means of distance communication has a withdrawal period of fourteen (14) days from the date of receipt of the Product to return to his order.

It is specified that in the case of an order relating to several goods delivered separately or in the case of an order for a good consisting of multiple lots or parts whose delivery is staggered over a defined period, the period runs from the receipt of the last good or lot or the last part.

For contracts providing for the regular delivery of goods over a defined period, the period runs from the receipt of the first good.

Custom-made products are personalized products within the meaning of the Commercial Code, and therefore do not benefit from the right of withdrawal.

To exercise his right of withdrawal, the Customer has fourteen (14) days to inform OptimHal-ProtecSom SAS of his intention via the contact form ( https://boutique-allergie-fr.protecsom.com/contactez-nous ).

When the right of withdrawal is transmitted electronically online from the Shop, OptimHal-ProtecSom SAS will send the Customer, within 48 hours, an acknowledgement of receipt of the withdrawal.

The Customer must then return the Product within fourteen (14) days of sending their withdrawal request. The costs and risks of return shipping are borne exclusively by the Customer.

The Products are returned to OptimHal-ProtecSom SAS at the following address: OptimHal-ProtecSom SAS – BP 46 – Valognes – FRANCE.

The cost of returning the Product is the initial delivery cost under the standard delivery method offered by OptimHal-ProtecSom SAS at the time of ordering.

OptimHal-ProtecSom SAS undertakes to reimburse the Customer for the price of their order within 14 days of receiving the Products.

The Products must not have been used or damaged and must be returned intact in their original packaging with any accessories, user manuals and other documentation.

OptimHal-ProtecSom SAS cannot be held liable for any damage to the Product caused by the Customer.

18. INTELLECTUAL PROPERTY

The Client has no intellectual or industrial property rights over the Products, packaging, containers, OptimHal-ProtecSom SAS remaining the exclusive owner of all these rights.

Any use in any way whatsoever by the Client of the OptimHal-ProtecSom SAS trademark or any other trademark belonging to OptimHal-ProtecSom SAS or its suppliers and manufacturers is strictly prohibited, unless agreed to by OptimHal-ProtecSom SAS.

The content and structure of the Shop are protected by copyright and intellectual property rights worldwide.

In this respect, and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to any different or more restrictive provisions of the Intellectual Property Code.

Any reproduction or representation, in whole or in part, of any content present on the Shop (including any text, image, iconographic or photographic representation, trademark or logo) for any purpose and on any medium is prohibited. 

Failure to comply with this prohibition constitutes an infringement that may give rise to civil and criminal liability for the infringer. 

None of the provisions of these General Terms and Conditions of Sale shall be interpreted as granting the Customer a license to any intellectual property right.

19. PROTECTION OF PERSONAL DATA

OptimHal-ProtecSom SAS declares that it respects and undertakes to respect the regulations relating to personal data in force in France, and in particular the European General Data Protection Regulation of 27 April 2016 (GDPR) and the amended French Data Protection Act of 6 January 1978.

19.1. Data collected 

When a customer account is created and/or an order is placed, OptimHal-ProtecSom SAS collects personal data for the purposes of concluding, executing, managing, and invoicing the Contract. OptimHal-ProtecSom SAS may use the customer's personal data for marketing purposes in accordance with applicable legal requirements. This data collection is based on the performance of the Contract.

During data collection, some data must be provided and is indicated by an asterisk, others are optional.

OptimHal-ProtecSom SAS undertakes not to use the data collected for purposes other than those mentioned above (except when required by a competent judicial and/or administrative authority).

Your data is kept in active database for the duration of the Contract or 3 years from the last contact with you, and in archive database for a period of 5 years, the duration of the general statute of limitations. 

The recipient of the data is OptimHal-ProtecSom SAS. However, OptimHal-ProtecSom SAS reserves the right to transmit all or part of its Clients' personal data to its subcontractors for the purposes of the Contract, and in particular for the execution of any order.

OptimHal-ProtecSom SAS undertakes to take all necessary precautions to preserve the security of the data communicated and, in particular, to prevent it from being distorted, damaged or accessed by unauthorized third parties. 

The Customer has the right to request from OptimHal-ProtecSom SAS access to, rectification, erasure, or portability of their personal data. The Customer may also request a restriction of processing or object to the processing of their data. The Customer has the right to withdraw their consent to the processing of their data at any time.

Finally, the Client has the option of filing a complaint with the CNIL.

19.2. Cookies and other tracking technologies

During your visit to our Store, cookies may be placed on your computer, tablet or smartphone.

A "cookie" is a small text file that contains information specific to the user of the Shop. It is stored on the user's hard drive and can only be read by the server that provided it.

For example, cookies help us remember the customer's username on their next visit, understand their interactions with our content, and improve our content based on the information collected.

OptimHal-ProtecSom SAS disclaims its liability for any failure to fulfill its contractual obligations in the event of force majeure or fortuitous events, including, but not limited to, disasters, fires, internal or external strikes, internal or external failures or breakdowns, and in general any event preventing the proper execution of orders.

21. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are governed by French domestic law, excluding any international convention.

In the event of a dispute relating to these General Terms and Conditions or to the sale, the parties will try to resolve their dispute amicably as far as possible.

In the absence of an amicable agreement, the competent court is the Commercial Court of Cherbourg.

22. USE OF THE CONSUMER MEDIATOR

If the Customer is a "consumer" within the meaning of the preliminary article of the Consumer Code, he must first send us his complaint directly via the contact form of the Shop.

If this attempt fails, the Client may resort to conventional mediation or any other alternative dispute resolution method, including, free of charge, within one year of their complaint, contacting the competent consumer mediator as defined in Title 5 of Book I of the Consumer Code:
